Terms of Use

Effective July 1, 2026

These Terms of Use ("Terms") are a binding agreement between you and Ardents Dating LLC ("Ardents," "we," "us"), governing your use of the Ardents app and ardentsdating.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Community Guidelines, which are incorporated by reference.

Plain-English vocabulary used in the app and in these Terms: a Spark is a like; a Super Spark is a premium like; a Combustion is a mutual match; an Ardent Note is a message thread; Transmissions are 24-hour stories shared with your matches; your Thermal Signal is your profile; Ardent Prime is our paid subscription; a Signal Boost temporarily raises your profile's visibility; a Sparky Reply is a photo reply sent with a Spark.

1. Eligibility — 18+ Only

You must be at least 18 years old to create an account or use Ardents. By using the Service you represent that you are 18 or older, that you can form a binding contract, that you have never been convicted of a sexual offense or required to register as a sex offender, and that you are not prohibited from using the Service under applicable law.

2. Your Account

  • You are responsible for your account, your login credentials, and all activity under your account. Keep your password confidential and notify us at support@ardentsdating.com if you suspect unauthorized access.
  • You may maintain only accounts that represent you truthfully. Information you provide (name, birthdate, photos, relationship status) must be accurate.
  • One person per individual account. Couple profiles are addressed in Section 3.

3. Couples, Honesty, and Consent

Ardents is a couples-first service for couples, ethically non-monogamous, and polyamorous people, as well as singles. Because the entire product depends on honesty about relationship structures, the following are conduct rules, not suggestions:

  1. Both partners must consent to a couple profile. Creating or maintaining a couple profile requires the knowing, voluntary participation of both partners. Each partner links their own account; you may not create a couple profile on behalf of someone who hasn't agreed to it.
  2. No surprising people about partners. You must accurately represent your relationship status and structure. Do not present yourself as single if you are partnered and your partner is unaware of or has not consented to your use of the Service in the way you are using it; do not conceal a partner's existence from people you match with where your profile context implies otherwise.
  3. Honesty about who's involved. If your individual profile is linked to a couple, that linkage is displayed to other users (the "Coupled" indicator). Do not attempt to circumvent or misrepresent it.
  4. Consent in interactions. Respect other users' stated boundaries and seeking preferences. "No" is a complete answer.

Violating these rules is grounds for enforcement under Section 8, up to permanent termination.

4. Community Guidelines

You must accept our Community Guidelines during onboarding (we record the time of your acceptance), and you must follow them at all times. The Community Guidelines are part of these Terms. Where these Terms and the Guidelines overlap, the stricter rule applies.

5. Your Content and Our License to Display It

"Your Content" means everything you submit: photos, bio, prompt answers, Vibe tags, messages, photo replies, Transmissions, and your verification video.

  • You own Your Content. You represent that you have the rights to everything you post, and that any person appearing in your photos or Transmissions has consented to appearing there.
  • You grant us a limited license: a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers only) license to host, store, reproduce, adapt (e.g., resize/transcode), and display Your Content for the purpose of operating the Service — chiefly, showing your profile and content to other users as you direct, delivering your messages and Transmissions, and performing safety screening. This license ends when Your Content is deleted from the Service, except (a) where content was shared with other users and resides in their conversations as the Service is designed to work, and (b) limited retention for safety, legal compliance, or backup cycling, as described in the Privacy Policy.
  • We do not use Your Content for advertising or sell it to anyone.
  • Your verification video is never displayed to other users and is used only for verification and safety as described in the Privacy Policy.

6. Prohibited Conduct

You agree not to:

  • Harass, stalk, threaten, intimidate, or defame any person, on or off the Service;
  • Create fake, misleading, or impersonating profiles, or misrepresent your identity, age, or relationship status;
  • Use the Service for commercial solicitation of any kind, including escorting, sugaring-for-pay arrangements, paid content promotion (e.g., linking paid subscription platforms to solicit purchases), multi-level marketing, or advertising;
  • Involve minors in any way — anyone under 18 on the platform, in photos in a sexual context, or referenced in any sexualized manner. We report child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and law enforcement;
  • Post or share non-consensual content, including images of any person shared without their consent, and any form of non-consensual intimate imagery;
  • Share another user's private information or content outside the Service without their consent;
  • Use bots, scrapers, or automated tools; attempt to access other users' data; probe or circumvent our security measures (including Row-Level Security policies);
  • Circumvent blocks, bans, or feature limits (e.g., by creating new accounts after termination);
  • Use the Service for any illegal purpose.

7. Verification

To send messages, you must complete identity verification (a short selfie video performing a randomized pose, as described in the Privacy Policy). Unverified accounts can browse but cannot message. Both partners in a couple must be verified for the couple profile to be fully active. We may re-verify accounts and may deny or revoke verification at our discretion for safety reasons.

8. Moderation and Enforcement

  • Messages are screened by automated AI moderation (currently OpenAI's Moderation API). Content flagged by automated systems may be quarantined (held and not delivered to the recipient) and may be reviewed by humans.
  • Users can block and report others. Reports are stored and reviewed. We aim to review and act on reports within 24 hours — this is a target we work toward, not a guarantee.
  • We may, at our discretion and with or without notice: remove content, quarantine messages, restrict features, suspend accounts, or terminate accounts that we reasonably believe violate these Terms, the Community Guidelines, or applicable law, or that pose a risk to other users.
  • We aim to be proportionate, and where reasonable we will tell you what happened — but for safety-critical violations (e.g., minors, non-consensual content, credible threats) termination may be immediate and permanent.
  • We are not obligated to monitor all content, and automated screening does not guarantee that harmful content will be caught.

9. Subscriptions, Purchases, and Virtual Items

9.1 Ardent Prime (auto-renewing subscription)

  • Billing is handled by Apple through In-App Purchase. We use RevenueCat to manage subscription status. We never see your payment card details.
  • Pricing:
    • Standard: $29.99 per month.
    • Founders Rate: $19.99 per month, available from launch through December 21, 2026.
    • Annual: $199.99 per year (may be offered at a later date).
    • Prices are in USD; Apple may adjust local-currency pricing, and prices may change for new subscription periods with notice as required by Apple and applicable law.
  • Auto-renewal: your subscription renews automatically at the end of each period unless you cancel at least 24 hours before the current period ends. Manage or cancel in your App Store subscription settings (iOS Settings → your name → Subscriptions). Deleting the app or deleting your Ardents account does not cancel the subscription — you must cancel through Apple.
  • Founders Rate condition: the $19.99/month Founders Rate is grandfathered only while your subscription remains continuously active. If you cancel or your subscription lapses for any reason, the Founders Rate is permanently lost, and any future subscription will be at then-current standard pricing.

9.2 Complimentary promotional access

We may grant complimentary promotional access to Ardent Prime to selected accounts or account types for limited periods, at our sole discretion. Complimentary promotional access confers no entitlement to future access, may be modified or ended at any time, and has no cash value.

9.3 Consumables and virtual items

We plan to offer consumable packs via In-App Purchase (e.g., Super Sparks, Sparky Replies, and Signal Boosts, in packs of 5 or 10). The free tier includes daily allowances of certain features. All virtual items, balances, allowances, and subscription benefits are limited, revocable licenses to use features within the Service — not property. They have no cash value, cannot be transferred, sold, or redeemed for money, and are forfeited when your account is terminated or deleted (except where a refund is required by law). 10. Safety Disclaimer

We do not conduct criminal background checks or identity screening beyond the verification video described above. We make no representations about the conduct, identity, intentions, or compatibility of any user. You are solely responsible for your interactions with other users.

Use common-sense precautions, especially when meeting in person:

  • Meet in a public place for first meetings; tell a friend where you're going;
  • Don't share financial information or send money to anyone you meet on the Service — ever;
  • Arrange your own transportation;
  • Report concerning behavior in-app immediately.

11. Disclaimers of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT CONTENT MODERATION WILL CATCH ALL HARMFUL CONTENT, OR THAT YOU WILL FIND A MATCH. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) ARDENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, GOODWILL, OR PROFITS; (b) ARDENTS WILL NOT BE LIABLE FOR THE CONDUCT OF ANY USER, ON OR OFF THE SERVICE, INCLUDING CONDUCT DURING IN-PERSON MEETINGS; AND (c) OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (ii) $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Ardents Dating LLC and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service, (c) your conduct toward other users, or (d) your breach of these Terms — except to the extent caused by our own negligence or misconduct.

14. Dispute Resolution and Arbitration

  • Informal resolution first. Before filing any claim, you agree to email support@ardentsdating.com describing the dispute and give us 30 days to try to resolve it.
  • Binding arbitration. Except as set out below, any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and Ardents each waive the right to a jury trial and to participate in a class action.
  • Small-claims carve-out. Either party may bring an individual claim in small-claims court instead of arbitrating, if it qualifies.
  • Injunctive-relief carve-out. Either party may seek injunctive or equitable relief in court for intellectual-property infringement or unauthorized access to the Service.
  • 30-day opt-out. You may opt out of this arbitration agreement by emailing support@ardentsdating.com within 30 days of first accepting these Terms, with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
  • Severability of class waiver. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court.

15. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 14. If you live in a jurisdiction whose consumer-protection laws give you mandatory rights, nothing in these Terms reduces those rights.

16. Termination

  • By you: delete your account in-app at any time (Settings → Delete Account), or deactivate to pause without deleting. Deleting your account does not cancel an active Apple subscription — cancel separately in App Store settings (see Section 9.1 and the Refund & Cancellation Policy).
  • By us: we may suspend or terminate your account as described in Section 8. Upon termination, your license to use the Service ends and virtual items/balances are forfeited (Section 9.3).
  • Sections that by their nature should survive (5 (license tail as described), 11–15, and accrued payment obligations) survive termination.

17. Changes to These Terms

We may update these Terms. For material changes, we will notify you in the app or by email before they take effect, and your continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and delete your account before the changes take effect.

18. Miscellaneous

  • These Terms, the Privacy Policy, the Community Guidelines, and the Refund & Cancellation Policy are the entire agreement between you and Ardents about the Service.
  • If any provision is found unenforceable, the rest remain in effect.
  • Our failure to enforce a provision is not a waiver.
  • You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Apple is not a party to these Terms and has no obligation to provide support or maintenance for the Service. To the extent required by Apple's standard EULA terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • Export compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
